Medical Waste Disposal in Georgia: Regulations and Compliance Guide

Georgia regulates medical waste, which the state classifies as "biomedical waste," through the Georgia Environmental Protection Division (GA EPD) under Rule 391-3-4-.15. Whether you operate a hospital, outpatient surgery center, dental practice, veterinary clinic, or laboratory in Georgia, this rule governs how you must handle, store, transport, and dispose of biomedical waste.

This guide covers the Georgia-specific regulatory framework, generator classifications, waste categories, and the practical steps your facility needs to follow to maintain compliance.

What Georgia Considers Biomedical Waste

Georgia's definition of biomedical waste is specific. Under GA EPD Rule 391-3-4-.15, the following categories of waste are regulated as biomedical waste:

  • Pathological waste: Human tissues, organs, and body parts removed during surgery, autopsy, or other medical procedures.
  • Biological waste: Blood and blood products in liquid or semi-liquid form, as well as items saturated or dripping with blood.
  • Cultures and stocks: Cultures and stocks of infectious agents from research and clinical laboratories, including specimen cultures, culture dishes, and devices used to transfer or inoculate cultures.
  • Contaminated animal materials: Animal carcasses, body parts, and bedding from animals that were intentionally exposed to infectious agents during research.
  • Sharps: Needles, syringes with attached needles, scalpels, lancets, broken glass contaminated with blood or infectious materials, and any other object that can penetrate skin and has been exposed to blood or potentially infectious materials.
  • Chemotherapy waste: Trace chemotherapy waste and materials contaminated with chemotherapy agents.
  • Discarded medical equipment: Medical equipment and parts that have been in contact with blood or infectious materials and have the potential for contamination.

Not everything that comes out of a healthcare facility is biomedical waste. General office trash, food waste, and non-contaminated packaging are regular solid waste and should not be placed in red bags or biomedical waste containers. Over-classification increases disposal costs without improving safety.

Generator Classifications: Small vs. Large

Georgia divides biomedical waste generators into two categories based on monthly volume:

Small Generators (Less Than 100 Pounds per Month)

Facilities producing less than 100 pounds of biomedical waste per month are considered small generators under Georgia law. Small generators are exempt from most provisions of Rule 391-3-4-.15, but they must still:

  • Package biomedical waste in proper containers (leak-proof, puncture-resistant for sharps, labeled with the biohazard symbol)
  • Use an authorized transporter for off-site disposal
  • Ensure waste is treated at a permitted facility

Many physician offices, small dental practices, and home health agencies fall into the small generator category. The reduced regulatory burden does not eliminate the obligation to handle waste safely and dispose of it properly.

Large Generators (100 Pounds or More per Month)

Facilities at or above 100 pounds per month are subject to the full requirements of the rule, including:

  • Registration with the Georgia Department of Natural Resources
  • Full container and labeling compliance
  • Use of authorized and registered transporters
  • Quarterly reporting to GA EPD
  • Record retention for a minimum of three years

Hospitals, surgery centers, large clinics, and laboratories will typically fall into this category. If you are unsure of your monthly volume, track your waste output for 2-3 months by weighing containers at each pickup.

Container and Labeling Requirements

Georgia requires all biomedical waste containers to meet specific standards:

  • Construction: Containers must be sturdy, leak-proof, and, for sharps, puncture-resistant. Red bags used for soft waste must be able to contain the waste without tearing or leaking during handling and transport.
  • Labeling: Every container must display the universal biohazard symbol and be labeled "Biohazardous Waste." Labels must be visible and legible.
  • Sharps containers: Must be rigid, puncture-resistant, leak-proof, and closable. When the container reaches the fill line (typically three-quarters full), it must be sealed and prepared for pickup or mail-back disposal.
  • Closure: Containers must be securely closed before being moved from the point of generation to the storage area and again before transport off-site.

Storage Requirements

Georgia requires that biomedical waste be stored in a manner that prevents unauthorized access, minimizes exposure to employees and the public, and prevents the release of waste into the environment.

  • Secure area: The storage area must be accessible only to authorized personnel. It should be clearly marked with biohazard signage.
  • Separation: Biomedical waste must be stored separately from clean supplies, food service areas, and public access areas.
  • Containment: The storage area should have a cleanable surface and the ability to contain any spills or leaks from waste containers.
  • Time limits: For specific storage time and temperature requirements, consult GA EPD directly, as these requirements are subject to updates. Best practice is to arrange pickup before waste has been stored for 30 days.

Transport and Treatment

Authorized Transporters

Georgia requires that biomedical waste be transported only by transporters authorized and registered with the state. Transport requirements include:

  • Vehicles must be labeled to indicate they are carrying biomedical waste
  • Manifests or tracking documents must accompany every shipment, recording the generator name and address, transporter information, quantity and type of waste, date of pickup, and destination facility
  • Transporters must follow spill response and cleanup procedures in the event of an accident

Never transport biomedical waste in personal vehicles, unmarked vehicles, or vehicles not designed for waste transport.

Treatment Methods

Georgia approves the following treatment methods for biomedical waste:

  • Incineration: Destruction by burning at a permitted incineration facility.
  • Autoclaving: Steam sterilization at a permitted treatment facility. After autoclaving, the waste is rendered non-infectious and can be disposed of as regular solid waste.
  • Other state-approved techniques: Georgia may approve alternative treatment technologies on a case-by-case basis. Contact GA EPD for currently approved methods.

Record-Keeping and Reporting

Large generators in Georgia must maintain comprehensive records and submit regular reports:

  • Manifests: Retain a copy of the manifest or tracking document for every biomedical waste shipment. These records prove that waste left your facility and was received at a permitted treatment facility.
  • Treatment certificates: Obtain and file certificates confirming that waste was properly treated at the destination facility.
  • Quarterly reports: Submit quarterly reports to GA EPD as required by the rule.
  • Record retention: Maintain all biomedical waste records for a minimum of three years.
  • Training records: Document all staff training related to biomedical waste handling. OSHA requires annual bloodborne pathogen training for employees with occupational exposure, which overlaps with but is separate from state biomedical waste requirements.

How Georgia Compares to Other States

Georgia's 100-pound small generator threshold is higher than both Texas (50 pounds) and Arizona (40 pounds). This means some facilities that would be classified as large generators in Texas or Arizona may qualify as small generators in Georgia, with reduced regulatory obligations.

However, Georgia's reporting requirements are more frequent than some states. The quarterly reporting requirement to GA EPD adds a documentation obligation that not all states impose. Facilities operating in multiple states should track these differences carefully.
